Do you need a license—and specifically a motorcycle license—to drive a Moped, Vespa or other motorized scooter? This question has been getting a lot of attention over the past couple of weeks, in light of Gwyneth Paltrow's run-in with TMZ photographers. Maybe you saw the headlines: “Actress Gwyneth Paltrow Cuts off School Bus on Vespa” (while transporting a child, no less). Then, not one week later, she announced that she had obtained her motorcycle license. It's not your typical motorcycle accident story, but it raises some very important issues.

Yes, like many people, I was stunned by the footage I saw. All motorists should use caution and common sense, especially when transporting a small child, but thankfully no one was hurt. As it turns out, though, this story has done some good, as it has raised a great deal of awareness about proper licensing. Many people who ride Vespas and other motorized scooters are unaware of the fact that they are required to have an M-Class license, as these vehicles are classified under the same laws as motorcycles.

California Motorized Scooter Laws – A Motorcycle Accident Lawyer Weighs In

For anyone who rides a Vespa or motorized bicycle in the State of California, you are required to obtain a valid M1 or M2 motorcycle license, unless the scooter is less than 1,000 watts or incapable of exceeding 20 miles per hour. Motorized scooters and similar vehicles also have the same insurance requirements as other motor vehicles.

Of course, these laws apply specifically to California, and the requirements can vary dramatically from state to state. If you live outside of California, and are thinking of purchasing (or already own) a Vespa, Moped or other motorized scooter, make sure to review the laws in your state. Don't simply assume your basic driver's license has you covered. Chances are it does not.

Treat your motorized scooter exactly as you would treat a motorcycle. Always wear a helmet, obey the laws and drive defensively. Never operate your scooter while under the influence of alcohol, and while you're at it, try not to cut off any school buses.
